Terms of Use
Effective September 3, 2026
These Terms of Use (“Terms”) govern your access to and use of the websites, mobile experiences, and services (collectively, the “Services”) offered by Erosyn Rx Inc (“Erosyn Rx,” “we,” “us,” or “our”). By creating an account, completing an intake, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. What Erosyn Rx is, and is not
Erosyn Rx is a technology platform that connects you with independent, licensed healthcare providers and with licensed pharmacies and laboratories. Erosyn Rx does not practice medicine, does not provide medical advice, and does not dispense medications. Medical care is provided by independent providers who are solely responsible for the care they render. The provider-patient relationship is between you and the provider.
The Services are not for emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. The Services are not appropriate for urgent or emergency medical conditions.
2. Eligibility
You must be at least 18 years old, a resident of the United States, and physically located in a state where our provider network is licensed to use the Services. You agree to provide accurate, current, and complete information during intake and to keep it updated. Providing false information may result in inappropriate care and is grounds for termination.
3. No guarantee of treatment
Completing an intake or paying any fee does not guarantee that a provider will prescribe any medication or recommend any course of treatment. Providers prescribe only when, in their independent clinical judgment, treatment is appropriate. A provider may decline to prescribe, recommend a different treatment, request additional information or labs, or refer you elsewhere.
4. Compounded medications
Some treatments offered through the Services may be compounded preparations dispensed by licensed compounding pharmacies. Compounded medications are not approved by the U.S. Food and Drug Administration (FDA) and are not reviewed by the FDA for safety, effectiveness, or manufacturing quality. You should discuss the risks and benefits of any compounded medication with your provider before starting treatment.
5. Fees, billing, and subscriptions
- Membership / consultation fees cover access to the platform and provider review of your intake and ongoing care. Medication is priced and billed separately by the dispensing pharmacy and is quoted to you before you are charged.
- Certain plans are offered on a recurring subscription basis. By enrolling, you authorize us or our payment processor to charge your payment method on a recurring basis until you cancel.
- You may cancel a subscription at any time as described in your account or by contacting us; cancellation stops future billing but does not entitle you to a refund of fees already incurred except as stated in our Refund & Returns Policy.
- You are responsible for all applicable taxes and for keeping your payment information accurate.
Refunds are governed by our Refund & Returns Policy. Shipping is governed by our Shipping Policy.
6. Your responsibilities
- Use the Services and any medication only as directed by your provider and the product labeling.
- Do not share your account, medications, or prescriptions with anyone else.
- Attend follow-up visits and report side effects or changes in your health to your provider promptly.
- Keep your login credentials confidential; you are responsible for activity under your account.
7. Telehealth consent
Use of the Services for care requires your agreement to our Telehealth Informed Consent. Please review it before your consultation.
8. Privacy
Our collection and use of your information is described in our Privacy Policy and, for protected health information, our HIPAA Notice of Privacy Practices.
9. Intellectual property
The Services, including all content, trademarks, logos, and software, are owned by Erosyn Rx or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Services for your personal, non-commercial use. You may not copy, modify, distribute, or create derivative works without our written permission.
10. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Erosyn Rx does not warrant that the Services will be uninterrupted, error-free, or secure. Erosyn Rx does not control and is not responsible for the independent medical judgment of providers or the products dispensed by pharmacies.
11. Limitation of liability
To the fullest extent permitted by law, Erosyn Rx and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Services. Our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to Erosyn Rx in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold harmless Erosyn Rx from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.
13. Dispute resolution and arbitration
Please read this section carefully. Except where prohibited by law, any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration, and not in court, except that either party may bring a claim in small-claims court. You and Erosyn Rx waive the right to a jury trial and to participate in a class action. You may opt out of arbitration by notifying us in writing at [email protected] within 30 days of first accepting these Terms.
14. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Subject to the arbitration provision above, the state and federal courts located in Texas will have exclusive jurisdiction over any dispute not subject to arbitration.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
16. Contact
Questions about these Terms can be sent to [email protected].
Erosyn Rx is a telehealth platform that connects patients with independent licensed providers. Providers prescribe only when clinically appropriate; completing an intake is not a guarantee of eligibility, of a prescription, or of any particular outcome. Compounded medications are not FDA-approved products and are not reviewed by the FDA for safety, effectiveness, or manufacturing quality. Statements on this site have not been evaluated by the Food and Drug Administration. Nothing here is medical advice — talk to your provider about your own situation.
